1. Acceptance of Terms

By accessing or using MySmileBridge's services, website, mobile application, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms, you may not access or use our Services. We reserve the right to modify these terms at any time, and your continued use of the Services constitutes acceptance of any changes.

You must be at least 13 years old to use our Services. If you are between 13 and 18, you must have parental or guardian consent.

2. Medical Disclaimer

MySmileBridge's AI analysis and recommendations are for informational purposes only and do not constitute medical advice, diagnosis, or treatment.

2.1 Not a Medical Device

MySmileBridge is a wellness and educational tool, not a medical device. Our AI-powered scans and assessments are designed to help you monitor your oral health and connect with dental professionals, but they should never replace professional dental examinations or treatment.

2.2 Professional Consultation Required

Always seek the advice of your dentist or other qualified healthcare provider with any questions you may have regarding a dental condition. Never disregard professional medical advice or delay in seeking it because of something you have read or seen through MySmileBridge.

2.3 Emergency Situations

If you are experiencing a dental emergency (severe pain, bleeding, trauma, or infection), do not use MySmileBridge. Call 911 or go to your nearest emergency room immediately.

2.4 AI Limitations

While our AI technology is trained on extensive dental data and validated by professionals, it has limitations and may not detect all dental conditions. False positives and false negatives are possible. Always verify AI findings with a licensed dentist.

3. User Accounts and Registration

3.1 Account Creation

To use certain features of MySmileBridge, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities. You may also terminate your account at any time through your account settings.

4. Use of Services

4.1 Permitted Use

You may use MySmileBridge for personal, non-commercial purposes to monitor your oral health, access educational content, connect with dental professionals, and track your dental care journey.

4.2 Prohibited Activities

You agree not to:

  • Use the Services for any illegal purpose or in violation of any laws
  • Upload false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Services or servers
  • Upload viruses, malware, or other malicious code
  • Scrape, crawl, or harvest user data without permission
  • Use the Services to provide medical advice to others
  • Share your account credentials with others
  • Use automated systems or bots without authorization

4.3 User Content

You retain ownership of any photos, scans, or other content you upload to MySmileBridge ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content solely for the purpose of providing our Services and improving our AI models (with anonymization).

5. Teledentistry Services

5.1 Platform Role

MySmileBridge acts as a platform connecting users with independent licensed dental professionals. We do not practice dentistry or provide medical advice. All dental consultations are provided by licensed dentists who are independent contractors, not employees of MySmileBridge.

5.2 Provider Qualifications

We verify that all dentists on our platform are licensed and in good standing. However, we do not supervise, direct, or control the professional services provided by dentists. The dentist-patient relationship is directly between you and the provider.

5.3 Consultation Limitations

Teledentistry consultations have limitations. Certain conditions require in-person examination. The consulting dentist will advise you if an in-person visit is necessary.

5.4 Cancellations and Refunds

Please review our cancellation and refund policy in your account settings. Generally, cancellations made at least 24 hours before a scheduled consultation are eligible for a full refund.

6. Payments and Subscriptions

6.1 Free and Paid Services

MySmileBridge offers both free and paid features. Free features include basic AI scanning, educational content, and community access. Premium features require a subscription or one-time payment.

6.2 Subscription Terms

Subscriptions automatically renew unless you cancel before the renewal date. We will charge your payment method on file at the beginning of each billing period. Prices may change with 30 days' notice.

6.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial subscription periods.

6.4 Payment Information

You agree to provide current, complete, and accurate payment information. We use third-party payment processors and do not store your full payment card details.

7. Intellectual Property

7.1 Our Rights

MySmileBridge and its original content, features, and functionality are owned by MySmileBridge Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.

7.3 Trademarks

MySmileBridge, the MySmileBridge logo, and other marks are trademarks of MySmileBridge Inc. You may not use these trademarks without our prior written permission.

8. Disclaimers and Limitations of Liability

8.1 "As Is" Basis

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 No Guarantee

We do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that our AI analysis will be accurate or reliable. Your use of the Services is at your own risk.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMILEBRIDGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE SERVICES.

8.4 Maximum Liability

Our total liability to you for all claims arising from or related to the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless MySmileBridge, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

10.2 Arbitration

Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in San Francisco, California, except that you may assert claims in small claims court if they qualify.

10.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and MySmileBridge individually. You waive any right to participate in any class action or class-wide arbitration.

11. General Provisions

11.1 Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or in-app notification at least 30 days before they take effect.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MySmileBridge regarding the Services and supersede all prior agreements.
